公共数据授权运营的关键问题与实施架构研究

摘要： 公共数据授权运营是充分释放公共数据价值的重要途径，自国家“数据二十条”出台以来，各地纷纷加快公共数据授权运营建设工作的部署。系统分析了公共数据授权运营的理论研究成果和地方实践经验，提出了我国公共数据授权运营发展大致经历了基础准备、试点探索、加速落地三个阶段；归纳总结了地方实践过程中，在授权主体、授权路径、数据供给、平台建设、收益分配、服务生态六方面仍存在亟待解决的问题；最后，以问题为导向，构建了制度规则、基础设施、运营生态相结合的实施架构，以期为地方政府更加高效有序地开展公共数据授权运营工作提供有效借鉴。

Research on the key considerations and architecture framework for implementing public data authorization operation

Abstract： The authorized operation of public data plays a crucial role in unlocking its value. Following the establishment of a fundamental data policy in December 2022, local governments have rapidly accelerated the deployment of construction work specific to public data authorization operations. This paper thoroughly investigates the theoretical research and practical experience, outlining how the evolution of the authorized operation of public data transitioned through basic preparation stage, the pilot exploration stage, and the accelerated landing stage. Additionally, this paper also identifies key challenges including authorization subject, authorization path, data supply, platform construction, revenue distribution, and service ecology, all in consideration of local realities. In response to these challenges, this research proposes an engineering implementation framework that combines institutional rules, infrastructure, and operation ecology. This framework aims to serve as a practical guide for local government to manage the authorization of public data more effectively and systematically.

引言
“公共數據授權運營”是具有中國特色的公共數據開發利用探索路徑，是數據要素市場化配置改革的關鍵突破口，對于加快數字經濟發展、數字中國建設具有戰略性支撐作用。2022年12月，國務院印發《中共中央 國務院關于構建數據基礎制度更好發揮數據要素作用的意見》（下文簡稱《數據二十條》），從國家層面對公共數據授權運營建設提出了具體要求，公共數據授權運營工作按下快進鍵。2023年以來，各地公共數據授權運營制度建設提速，部分先發地區正邁入實踐落地與規范發展階段，取得了一定的進展和成效。然而，公共數據授權運營是一項開創性、探索性的改革任務，具體實踐落地過程中仍面臨著制度規范不完善、公共數據安全保障難度大、參與主體積極性不高等問題，制約著公共數據在更廣范圍、更深層次、更高質量的開發利用。當前，以地方政府主導授權和以垂直領域行業管理部門牽引授權的探索均積極推進，本文重點針對地方政府授權模式開展研究。如何清晰地認識公共數據授權運營的演進過程和關鍵問題，并探索構建公共數據授權運營系統化落地方案，將對突破現階段地方實踐瓶頸具有重要借鑒意義。
